【補足】CAFC、Inequitable Condcutの基準について判示

Therasense v. Becton Dickinsonでは、”intent”と”materiality”の双方が独立に証明されなければならないことを明確にし、いわゆる”sliding scale”も否定しています(“A district court should not use a “sliding scale,” where a weak showing of intent may be found sufficient based on a strong showing of materiality, and vice versa.”)。

Inequitable Conduct成立の要件については、従来の考え方をリセットしないといけないようです。
